Leaked Memorandum of Understanding Between Dbeibah and Turkey: Significant Concessions on Libyan Rights
The Memorandum of Understanding (MoU) signed in March between Dbeibah and Turkey regarding the status of Turkish forces in Libya has been leaked after Turkish President Recep Tayyip Erdoğan submitted it to the Turkish parliament for approval.
The MoU consists of 24 articles granting Turkish forces extensive powers and privileges, including logistical support during their operations on Libyan territory.
Article 7 provides Turkish forces with unrestricted access to Libyan airspace and territorial waters. Turkish forces are entitled to use any movable or immovable properties that have been allocated to them, either currently or in the future.
The Libyan government commits not to demand any incidental fees, charges, or rent for the use of the allocated movable properties or their potential disposal, and to fulfill the technical requests of Turkish forces regarding the use of airspace.
Article 11 states that any crimes committed by Turkish military personnel during their official duties or within the scope of their responsibilities will be subject to Turkish law.

Article 12 permits Turkish personnel to carry personal weapons and service weapons and wear their uniforms while on duty.
Additionally, Turkish naval vessels entering Libyan maritime zones and territorial waters, as well as their crews and any related materials or munitions transported by these vessels, are exempt from all fees.
Libya will bear the costs of any contracts and purchases made by Turkish forces to fulfill their duties after consultation with Libyan authorities. Furthermore, the commander of the Turkish forces is authorized to contact local police, security, and intelligence units in Libya directly.
The MoU is valid for three years from the date of its entry into force, with the possibility of automatic renewal for one year unless one of the parties notifies the other of its intention to terminate the agreement.
